If you're an influencer, you've probably experienced this scenario: You're scrolling through Instagram or TikTok, and suddenly…there it is. YOUR video. But not on your page.
A brand has reposted your video (or photo) on their page. Maybe they tagged you, maybe they didn’t. It feels flattering for a quick second. Until you realize that you never gave them permission to use your content, and you definitely weren’t paid for it.
Unfortunately, a lot of brands operate under the assumption that “tagging” or “crediting” the influencer is enough. But it’s not. Just because your post is on a public platform, does not mean that brands have the right to repurpose it for marketing. This is YOUR intellectual property.
That is the definition of usage and usage requires an agreement and payment. And if you don’t have either, the brand is quite literally breaking copyright law.
So, now what?
